Creator Terms

1. Introduction

Welcome to our creator terms! Since 2014 we’ve been providing our users with a place to sell and buy products, do and post jobs and meet other members of the Garry’s Mod community. Since 2024 we have expanded to the video game, Rust.

We’re the people behind the marketplace, Everyday. You can find us at Everyday AS (914840368), Bragernes Torg 8, 3017 Drammen , Norway. By using pronouns like ‘we’, ‘us’, ‘our’ or directly using ‘Everyday’ in these terms we refer to Everyday AS. When we say ‘Pivity’ we refer to our marketplace and the marketplace application. This includes all of our marketplace sub-brands, including, but not limited to: GmodStore and RustStore.

Being a creator at Pivity is a great way to kickstart your creative programming career. Managing purchases, updates, support tickets and customer interactions is a part of your journey and is a valuable experience for anyone wanting to reach for the stars.

2. Sounds awesome, how do I become one?

You can become a creator by submitting your first product to the marketplace that appeals to you the most. Make sure to read up on our help & support knowledge base about being a creator and submitting a product. More details are laid out in the next section.

3. Product Guidelines and Standards Compliance

Before you can start selling on Pivity your product needs to pass our standards compliance curation queue. These standards and guidelines are outlined in our "Developer Guidelines for Products" knowledge base articles for each individual marketplace. You acknowledge that the guidelines or standards may change or be revised from time to time and will be applicable to all products you sell on our marketplaces.

4. What you need to know about selling

4.1. Licencing

When you sell a product on Pivity you are selling a non-exclusive licence to use your product. This means you retain ownership of your product while your customers only get a licence to use your product.

4.2. Teams

A key feature of Pivity is that products need to be a part of a team. A team must at minimum consist of one product and one primary team owner.

You can add more creators and products to your team as you grow. Each creator can be assigned a percentage of the revenue stemming from that team.

It’s important to note that when we mention a creator of a product we are referring to the team behind the product, not just an individual creator. In some cases there has to be a responsible individual and in those cases we refer to the primary team owner.

4.3. Pricing

You decide what to price your products at yourself, however we operate with a minimum market price in an attempt to minimize severely undershooting competition. This minimum price is currently set at $4.99 for standalone products and $2.99 for downloadable content (‘DLC’).

4.4. Support

We urge you to provide support for your products for as long as possible. Creating a knowledge base and filling it with all the most frequently asked questions and how to’s is another great way to help your customers if you keep getting the same support questions repeatedly.

While we want you to provide support we do not require you to keep supporting your products forever. All we ask is that you mark your products as unsupported as soon as you decide you are not going to provide support anymore. Keep in mind that unsupported products are not immune to being removed from the marketplace as we still require that your product actually works.

Please see section 7 and 8 to find out more regarding your warranties and responsibilities as well as why and when we might remove products from our marketplace.

5. Revenue and payouts

5.1. Revenue

When a customer purchases your product on Pivity the price is made up of the price you set yourself with the VAT payable by the customer added onto it, if applicable. You can read more about taxes and VAT imposed on your customers and in what cases we deal with VAT for you in section 6.1.

After we deduct the VAT from the price we also deduct our commission from your earnings, this rate varies per Pivity marketplace. Please refer to the table below. This means if you are the only member of your team the revenue you receive is the total price of the product, less the commission fee and any fees imposed by the customer’s payment gateway of choice.

Your earnings are deposited into a virtual wallet. The wallet is neither a bank account nor any kind of payment gateway. Any balance you hold in your Wallet represents an unsecured claim against Everyday.

We reserve the right to refund a customer using your wallet balance on your behalf in accordance with our Refund Policy.

5.2. Withdrawing your balance

In order to withdraw money from your wallet balance you are required to set up a payout account with Pivity for your preferred payout method. Everyday reserves the irrevocable right to hold your wallet balance indefinitely until you set up a payout account with Pivity. We will continue to hold your earnings if we're not able to pay your earnings to you for whatever reason, including if:

  1. We do not have the correct payment details to facilitate a payment to you.
  2. We can't contact you using the details that you have given us.
  3. You are trying to transfer your earnings to a country, legal entity or person we are legally prohibited from making payments to, either by sanctions or other limitations imposed by banking systems.

Everyday is not to be held responsible for any payout delays initiated or otherwise caused by a third party payout provider or a bank. In addition, we ask you to understand that the time it takes to make a transfer between our third party payment agents and the third party payout providers is outside our control, this means that you should not hold Everyday responsible for any delays caused by a delayed transfer of funds between our accounts. We're only human and these things can unfortunately happen as some payment agents require us to manually transfer funds between them and our payout provider. We will do our best to make sure you receive your earnings as fast as possible.

5.3. Withdrawal fees

Your payout may be subject to currency conversion fees and other fees added by our payout facilitator. These fees are external, meaning we do not control these fees and we do not impose any other fee on your payouts.

5.4. Payout intervals

We will hold on to your earnings for as long as you have not set up a payout provider and until you have provided us with the correct payout details. We reserve the right to make a payout to your account outside of the normal payment schedule if an error occurs when making the original payout.

5.5. Balance related abuse or exploitation

In the unlikely event that you are able to generate a balance through unintended behaviour of Pivity, Everyday will reserve the right to hold your balance and restore it to the correct and intended amount. Everyday reserves the right to hold your balance for up to 180 days in the event that you violate these terms or the Marketplace Terms, additionally we reserve the right to issue a refund from your balance to a customer in the event that you violate these terms, the Marketplace Terms or the usage licence associated with the provided product, software or service.

6. Taxes and invoices

6.1. VATMOSS, Norwegian MVA

As a marketplace we assume certain responsibilities when it comes to taxes, and more specifically VAT. We are part of the European Union’s VATMOSS scheme (The VAT Mini One Stop Shop) through the non-union scheme, this allows us to collect the payable VAT from your European customers and pay it to the correct tax authorities for you. As we opted in through the non-union scheme we had to choose a designated member state of identification, this country is Sweden. Our VAT number is: EU752000139.

Because Everyday is a company registered in Norway this also applies to Norwegian VAT in the form of MVA (Merverdiavgift). This means that our creators do not have to worry about paying VAT or MVA to the EU and Norway.

6.2. Invoicing

We facilitate the invoices between you and your customers for you so you don’t have to worry about invoicing. Our invoices come in addition to the payment provider’s invoice.

7. Your warranties and responsibilities

As a creator on Pivity you have some responsibilities to both us and your customers, you warrant that you:

  1. Provide support to your customers for as long as you keep support enabled to avoid misleading them.
  2. Follow all creator guidelines set forth on Pivity and by Pivity staff.
  3. Abide by all our terms and conditions.
  4. Honour the usage licence of your products.
  5. Do not buy your own products.
  6. Keep your contact information up to date.
  7. Keep your payout details up to date.

8. Product removal

We may remove your product at any time, for any reason at our sole discretion. A reason for this could be if we find that you or your team members are violating any of Pivity’s terms and conditions or we are made aware of severe lacks, misrepresentations or errors in your product affecting multiple customers.

If your product is temporarily made unavailable or permanently removed we will not be liable for any lost revenue or profit.

9. Usage of product media in advertising

We may sometimes showcase new features of Pivity, and when we do we reserve the right to use public banners, media or videos from your products in our showcase. In addition, we reserve the same right in promotions of Pivity. We do not provide any form of compensation in these cases.
